1. Acceptance of Terms

By accessing or using the Bateman Outfitters website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use our Services. These Terms constitute a legally binding agreement between you and Bateman Outfitters, LLC.

2. Account Registration

To book tours, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account and book tours. Notify us immediately of any unauthorized account access.

3. Tour Bookings

When you book a tour, you enter into a contract with Bateman Outfitters for the selected experience. All bookings are subject to availability. Prices displayed include applicable taxes unless otherwise stated. Full payment is required at the time of booking through our secure payment processor, Stripe.

You are responsible for ensuring all travelers in your booking meet any stated requirements, including age, fitness level, and documentation.

4. Cancellation and Refund Policy

• Free cancellation: Full refund if cancelled at least 24 hours before the scheduled tour start time.
• Late cancellation: Cancellations within 24 hours of the tour start time are non-refundable.
• No-shows: No refund for no-shows.
• Operator cancellation: If we or the tour operator cancel a tour, you will receive a full refund or the option to rebook at no additional cost.
• Weather: Tours cancelled due to severe weather conditions will be rescheduled or refunded at our discretion.

5. User Conduct

You agree not to:

• Use the Services for any unlawful purpose
• Impersonate any person or entity, or falsely state or misrepresent your identity
• Interfere with or disrupt the Services or servers connected to the Services
• Submit fraudulent reviews, bookings, or payment information
• Scrape, crawl, or use automated means to access the Services without authorization
• Engage in behavior during tours that endangers yourself, other participants, or the guide

6. Intellectual Property

All content on our platform, including text, images, logos, and software, is the property of Bateman Outfitters or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

7. Reviews and User Content

By submitting reviews, photos, or other content, you grant Bateman Outfitters a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with our Services. You represent that you own the content or have the right to submit it, and that it does not violate any third-party rights.

8. Limitation of Liability

Bateman Outfitters acts as a platform connecting travelers with tour operators and guides. While we vet all experiences, tours are ultimately delivered by independent operators. To the fullest extent permitted by law, Bateman Outfitters shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or participation in any tour.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the specific tour giving rise to the claim.

9. Assumption of Risk

Tour activities may involve inherent risks including physical exertion, exposure to weather, and travel in remote areas. By participating, you acknowledge and accept these risks. Tours rated "challenging" require appropriate fitness levels and may involve elevated risk.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bateman Outfitters, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of our Services.

11. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Wasatch County, Utah.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our platform at least 30 days before they take effect. Your continued use of the Services after changes constitute acceptance of the revised Terms.
